El Paso Home Services — Yard Cleaning Services, El Paso, Texas

These Terms and Conditions govern all yard cleaning and related services provided by El Paso Home Services ("we," "us," "our") to you ("Customer"). By scheduling, accepting, or allowing any service to be performed, Customer agrees to these Terms.

1. Deposit & Scheduling

A deposit of up to thirty percent (30%) of the total estimated service cost may be required prior to scheduling or confirming a service appointment. This deposit secures your service date and is applied toward the total amount due upon completion.

2. Cancellation & Rescheduling Policy

Customers must provide at least twenty-four (24) hours' notice prior to the scheduled service day if they wish to cancel or reschedule their appointment. Cancellations made with proper notice will receive a full refund of any deposit paid, less any out-of-pocket expenses incurred. Refunds will be processed promptly; however, depending on the Customer's bank or financial institution, it may take up to ten (10) business days for the refund to appear in the Customer's account.

Cancellations made with less than 24 hours' notice may result in forfeiture of the deposit or a partial cancellation fee, as determined by El Paso Home Services.

3. On-Site Verification of Work Completion

Upon completion of services, a person eighteen (18) years of age or older who has authority to accept service on behalf of the Customer is expected to be present to verify the completeness of work. If no authorized adult is present at the time of service, Customer acknowledges that the work will be deemed accepted absent written notice of objection submitted within 10 days of completion.

4. Pre-Existing Conditions & Damage Notification

During the course of service, our crew may discover materials or infrastructure already in deteriorated condition, including but not limited to plastic sheeting, weed barrier mesh, drainage pipes, irrigation components, or other materials located beneath or within decorative rock, bedrock, gravel, or soil. Such items may be damaged or degraded due to age, time, environmental exposure, or prior mechanical disturbance.

Any pre-existing deterioration discovered during service will be documented and reported to the Customer promptly. We are not liable for damage to materials already compromised or non-functional prior to service. Our obligation is limited to notifying the Customer of such conditions upon discovery. Repairs or replacements of pre-existing damaged items are outside the scope of standard service unless explicitly agreed upon in writing.

5. Weather & Acts of Nature

Services may be rescheduled, delayed, or temporarily suspended due to acts of nature, including but not limited to rain, high winds, lightning, extreme heat, flooding, or other unsafe conditions. Rescheduling due to safety concerns will not be deemed a breach of this agreement, and no penalty or refund will accrue solely due to weather-related rescheduling.

6. Underground Lines, Cables & Utilities

Our services disturb only the surface and near-surface of the yard. We are not responsible for damage to cables, wiring, irrigation lines, coax, telephone lines, invisible/pet fencing, or similar installations that are not properly buried or protected in accordance with applicable codes, or that were installed outside marked utility locations. Customers are encouraged to identify and mark any shallow or non-standard installations (invisible pet fences, landscape lighting wiring, drip irrigation, etc.) before service begins.

7. Yard Décor, Ornaments & Personal Property

Protecting your yard décor, statues, fountains, potted plants, and similar items is always a priority for our crew. However, we cannot guarantee their safety during service, and Customers are strongly encouraged to remove or secure all décor and personal property prior to service. We are not liable for damage to items left in the work area that could not reasonably be avoided during performance of the agreed scope of work.

8. Hoses, Toys & Loose Items

Customers are encouraged to remove hoses, toys, sporting equipment, furniture cushions, and other loose items from the work area prior to service to prevent loss or damage. We will exercise reasonable care around items that remain, but cannot guarantee their protection.

9. Insects & Hazardous Conditions

The presence of stinging insects (bees, wasps, hornets), venomous pests, or other hazardous conditions discovered during service may cause the service to be paused or canceled that day for crew safety. If work must stop partway through, Customer may be charged a reasonable portion of the total price for the work actually completed before stopping. It remains in our best interest to complete the full scope of work as agreed, and we will make commercially reasonable efforts to resume or reschedule the remaining work.

10. Pets & Animal Safety

Customers are responsible for keeping pets and other animals secured in a safe location while service is being performed. Due to frequent movement of crew and equipment throughout the property, gates and backyard doors may be left open for extended periods. Customers acknowledge this and accept responsibility for securing their animals. Any injury caused by a Customer's animal to our personnel during service is the Customer's responsibility.

11. Debris Removal

Only debris generated from the agreed-upon scope of work will be hauled away, and only if debris removal is expressly included in the service agreement. The following will not be hauled away: household trash, construction debris, dirt, fill, sod, stones, rock, gravel, concrete, hazardous materials, or items requiring special disposal under applicable law.

12. Payment Terms & Additional Work

Payment is due immediately upon completion of the agreed-upon services. Customer agrees to pay the full amount for all services rendered as outlined in the original service agreement.

Additional work requested by the Customer that is not included in the original scope of work may be performed upon mutual agreement. Such additional work does not constitute grounds for withholding payment for the original scope of services already completed. Payment disputes may only be raised regarding specific items or services that were not performed, were not authorized, or did not meet the standards outlined in the original agreement, and must follow the dispute resolution process in Section 14.

13. Non-Refundable Payment & Texas Penal Code § 31.04

By agreeing to these Terms, Customer acknowledges that once services are rendered and completed, payment is non-refundable except as otherwise agreed in writing or as required by law.

Initiating an unauthorized payment reversal or fraudulent chargeback for services that were actually performed is prohibited. Under Texas Penal Code § 31.04 (Theft of Service), a person who, with intent to avoid payment, secures services the person knows are provided only for compensation may commit a criminal offense. Wrongfully reversing or disputing a valid charge after services have been performed may fall within this statute.

If Customer is dissatisfied with completed work, Customer agrees to notify us in writing within ten (10) days of completion so we may attempt a good-faith resolution. In the event of an unauthorized payment reversal, we reserve the right to submit signed service logs, proof of completion, photographs, and communication records to payment processors, collection agencies, and local legal authorities for civil recovery or criminal referral under Texas law.

14. Dispute Resolution

Nothing in these Terms waives any right a consumer may have under the Texas Deceptive Trade Practices–Consumer Protection Act or other applicable law, nor does any provision waive rights that cannot be waived as a matter of law. All disputes regarding completed work must be raised in writing within ten (10) days of service completion. If an informal resolution cannot be reached, disputes shall be resolved in the courts of El Paso County, Texas, and these Terms are governed by the laws of the State of Texas.

15. Entire Agreement & Severability

These Terms, together with the written service agreement or estimate for each job, constitute the entire agreement between the parties. If any provision is found unenforceable, the remaining provisions will continue in full effect.
